Mohali: Family of UP man killed in road accident to receive ₹12 lakh

A motor accident claims tribunal ordered a motorcyclist, the bike owner, and an insurer to pay compensation to a migrant worker's family.

A motor accident claims tribunal on Friday ordered a motorcyclist, the owner of the motorcycle, and an insurer to pay ₹12 lakh to the family of a migrant worker. The worker died following a collision on the Chandigarh-Ambala highway in 2023, according to a report by Hindustan Times.

The incident occurred on August 2, 2023, when Prahlad Yadav, 48, was walking near the Jhilmil river. A motorcycle with registration HR-01-AV-6530 struck him from behind, causing him to hit his head. Yadav died on August 4 at GMCH-32 in Chandigarh after being referred from a hospital in Dera Bassi.

Presiding officer Atul Kasana issued the award on October 30, 2026, regarding a petition by Sonamati Devi, Visheshwar Yadav, and Reema Yadav. The family, residing in Hadiha Khurd village in Uttar Pradesh's Ballia district, had requested ₹60 lakh.

The tribunal rejected arguments from the rider, Tarun, and the owner, Kartik, who denied the accident. Liberty General Insurance also contested the claim, citing jurisdiction issues and the rider's lack of a valid licence. However, the tribunal found the testimony of eyewitness Rinku Ram to be reliable.

Because the family did not prove Yadav worked in Punjab, the tribunal used the Uttar Pradesh minimum wage for unskilled labour of ₹10,089 a month. After adding 25 per cent for future prospects and applying a multiplier of 13, the loss of dependency was fixed at ₹9,83,658.

The final award includes ₹1,45,200 for filial consortium and ₹18,150 each for funeral expenses and loss of estate. Sonamati Devi will receive 70 per cent of the amount, while Visheshwar and Reema Yadav will receive 15 per cent each.
